The ninth circuit court of appeals ruled on Tuesday that it would rehear the legal dispute concerning the executive power with an larger group of eleven justices. The court also overturned a earlier decision from a smaller judicial group that had sided with the federal government.

This legal directive represents the most recent development in a protracted legal battle over whether the administration has the legal right and justification to deploy national guard forces in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

The appeals court decision came after a US district judge in Portland enacted two temporary restraining orders this month – one preventing the federalization of the state troops, and another prohibiting the use of any military personnel in Oregon, after efforts to evade the initial injunction by mobilizing troops from California.

On the previous day, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the subsequent injunction stayed effective, blocking the physical sending of the troops.

The latest ruling means the issue will be heard by the full court – with both rulings under consideration simultaneously – by a panel of 11 judges.

“This ruling shows that the truth matters and that the courts are striving to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” stated the legal representative in a official comment.
